The terms apply to tenders of works, see sub-clause 1.2.13, and to contracts on works that have been tendered. The terms also apply to contracts on works without tenders, where appropriate. The terms may be applied, where appropriate, to tender procedures and contracts for the construction of parts of structures When a subcontractor performs a part of the work undertaken by the prime contractor for the buyer, the terms apply in the same manner to relations between the prime contractor and subcontractor, except as otherwise agreed between the parties. If provisions of the standard apply to contractual relations between the prime contractor and a subcontractor, the provisions relating to the buyer then apply to the prime contractor, and the provisions on the contractor apply to the subcontractor.
